ORDINANCE #24-08

AN ORDINANCE AUTHORIZING THE HIRING OF TWO SEASONAL EMPLOYEES FOR THE CITY OF UHRICHSVILLE WHEREAS: It is the judgment of the Legislative Authority of the City of Uhrichsville that two (2) seasonal employees are needed at this time:

WHEREAS: It has been determined that the funds are available to hire said employees.

THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UHRICHSVILLE AS FOLLOWS:

SECTION 1: This Ordinance repeals and replaces any provision in any prior ordinance or amendment that is consistent with the terms and requirements as provided and established herein.

SECTION 2: That the Mayor shall be given the authority to hire two (2) seasonal employees for the summer months.

SECTION 3: The first employee shall be paid at the hourly rate of seven ($7.00) Dollars per hour and shall work Twenty (20) hours per week. The second employee shall be paid at the hourly rate of eight ($8.00) Dollars per hour and shall work Thirty (30) hours per week.

SECTION 4: This ordinance is hereby deemed to be an emergency to protect the health, safety and welfare of the residents of the City of Uhrichsville, Ohio and shall go into full force and effect on the first day after its passage by the Uhrichsville Council as an emergency measure provided it receives the necessary votes.

ORDINANCE #25-08

AN ORDINANCE AUTHORIZING THE INCREASE OF WAGES AND BENEFITS

BE IT ORDAINED BY COUNCIL OF UHRICHSVILLE, STATE OF OHIO

WHEREAS: It is the judgment of the council of City of Uhrichsville, there is a need to increase the wages and benefits for the City Service Department Foreman.

SECTION 1: Whereas there is a need to grant a wage increase of seventy five (.75) per hour.

SECTION 2: Whereas an extra week of vacation is to be granted.

SECTION 3: This ordinance shall take effect with pay of July 1, 2008.

SECTION 4: This ordinance is hereby deemed to be an emergency to protect the health, safety and welfare of the resident of the city of Uhrichsville, Ohio and shall go into full force and effect upon its passage by Uhrichsville Council and signature of Mayor.

AN ORDINANCE FOR THE COUNCIL FOR THE CITY OF UHRICHSVILLE, TUSCARAWAS COUNTY, OHIO AUTHORIZING THE MAYOR TO SELL ANY UNUSED CITY EQUIPMENT.

WHEREAS: The city of Uhrichsville has equipment that is no longer used and would like to sell.

WHEREAS; It has been determined that the equipment will be advertised.

THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UHRICHSVILLE:

SECTION 1: This ordinance authorizes the mayor to advertise any equipment that is no longer being used. by the City.

SECTION 2: The Council has the right to accept or deny any or all bids for said equipment.

ORDINANCE #20-08

AN ORDINANCE PROHIBITING CERTAIN CONDITIONS WHICH CAUSE NUISANCES IN THE CITY OF UHRICHSVILLE

WHEREAS: The Council of the City of Uhrichsville has determined that it is necessary to prohibit certain activities which have been known to cause nuisances to the citizens of the City of Uhrichsville and to protect the health, safety and welfare of the residents of the City.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF UHRICHSVILLE, STATE OF OHIO.

SECTION 1: No person shall keep or harbor any animal or fowl in the City: 1. So as to create offensive odors or unsanitary conditions which are a menace to health, comfort or safety of the public. 2. Which, by frequent and habitual barking, howling, yelping or any other nuisance, creates unreasonably loud and disturbing noises of such a character, intensity and duration as to disturb the peace, quiet and good order of the City. 3. Which by its very presence and the nature of its temperament creates, or could so create, a menace to the health, comfort or safety of the public.

SECTION 2: This section shall not be construed so as to limit or restrict the operation of a lawful dog kennel.

SECTION 3: Whoever violates subsection (a) (3) hereof may be ordered to remove any such animal immediately from the corporate limits to a location where such animals are normally found.

SECTION 4: Violation of this Ordinance shall be a minor misdemeanor on the first offense. If the offender has a previous conviction under this Ordinance or any substantially similar law, statute or ordinance of this municipality, any other municipality in the State of Ohio, or under a state or federal statute, then violation shall be a forth degree misdemeanor. If the offender shall have two or more previous convictions then a violation shall be a third degree misdemeanor.

SECTION 5: The foregoing Ordinance was adopted and all actions and deliberations of the City of Uhrichsville, Tuscarawas County, Ohio relating thereto were conducted in open meetings to the public in compliance with all applicable legal requirements including Sections 121.22 of the Ohio Revised Code. This ordinance shall take effect and be in force immediately upon its passage and approved by Council and shall become effective upon passage by Council

ORDINANCE #12-08

AN ORDINANCE REPEALING THE PRIOR ORDINANCE AND ENACTING A NEW ORDINANCE REGULATING THE STORAGE OF JUNK VEHICLES

WHEREAS: The Council for the City of Uhrichsville has determined that it is in interest of the community and for reasons of safety and welfare o fits residents that a regulation the storage of junk vehicles within the City.

THEREFORE: be it ordained by the Council of the City of Uhrichsville as follows:

SECTION 1: Repeal This ordinance repeals and replaces Ordinance #19-02.

SECTION 2: Definitions:

A) “Person” as used in this ordinance means any person, firm, partnership, association,, corporation, company or other organization of any kind.

B) “Junk Vehicles” as used in this ordinance shall mean any vehicle meeting all the following requirements:

1. Left on private property for forty- eight (48) hours, or on a public street or other property open to the public for purposes of vehicular travel or parking, or upon or within the right of way of any road or highway, for forty- eight (48) hours or longer.

2. Three years old or older

3. Extensively damaged, such damage including but not limited to any of the following: missing wheels, tires, motor, or transmission.

4. Apparently inoperable

5. Having fair market value of one thousand five hundred ($1500.00) dollars or less

6. Visible from any public road, street or alley unless stored in a storage facility.

SECTION 3: Abandonment of Junk Vehicle

It shall be unlawful for any person to leave a junk vehicle, as defined above, on private property for seventy- two (72) hours or more, or on a public street or other property open to the public for purposes of vehicular travel or parking, or upon or within the right of way of any road or highway, for forty- eight (48) hours or longer without notification to the sheriff of the county or chief of the police of the municipal corporation, township or township police district of the reasons for leaving the motor vehicle in such place.

For purposes of this section, the fact that a motor vehicle has been do left without permission or notification is prima- facie evidence of abandonment.

SECTION 4: Disposition of Abandoned Junk Vehicle:

The Police Chief or Sheriff shall order any abandoned junk vehicles to be photographed by a law enforcement officer. The officer shall record the make of the abandoned junk vehicle, the serial number where available and shall also detail the damage or missing equipment to substantiate the value of One Thousand Five Hundred ($1500.00) dollars or less. The Police Chief or Sheriff shall thereupon immediately dispose of the abandoned motor vehicle to a licensed motor salvage dealer as defined in the Ohio Revised Code which is under contract to the municipality for the destruction of such motor vehicles. The record and photographs relating to the abandoned junk vehicle shall be retained by the law enforcement agency ordering the disposition of such vehicle for a period of at least two (2) years. The law enforcement agency shall execute in quadruplicate an affidavit, as prescribed by the registrar of motor vehicles, describing the motor vehicle and the manor in which it was disposed of, and that all requirements of Ohio Revised Code 4513.63 have been complied with and shall sign and file the same with the Clerk of Courts of the county in which the junk vehicle was abandoned. The Clerk of Courts retain the original of the affidavit for the Clerk’s files, furnishes one copy thereof to the registrar, one copy to the motor vehicle salvage dealer or other facility handling the disposal of the vehicle, and one copy with the records and photograph relating to the disposal. Any moneys arising from the disposal of an abandoned junk vehicle shall be deposited in the general fund of the municipality.

SECTION 5: Penalties

Whoever violates this section is guilty of a minor misdemeanor on a first offense and shall be assessed any costs incurred by the county, township or municipal corporation in disposing of such abandoned junk motor vehicles, less any money accruing to the county, township or municipality corporation from such disposal.

Each additional day that a vehicle is left abandoned shall be considered a separate offense. On a second offense, such person is guilty of a misdemeanor or the fourth degree. On each and every day subsequent offense the person is guilty of a third degree misdemeanor.
